SOMNOCARE Privacy Policy and Terms & Conditions

Somnocare takes all reasonable measures to operate in accordance with the Privacy Act 1988, the Freedom of Information Act 1992 (WA) and the Australia Department of Health guidelines. These acts and guidelines provide a framework that governs how medical and health services collect and use your personal and health records.

Collection of your information:

We must collect necessary personal and medical information to properly treat you. This information may include, but not be limited to:

  • Personal and family medical histories

  • Ethnicity background

  • Contact details

  • Medicare and health fund details

  • Account and billing information

This information will typically be collected directly from you, however Somnocare may also collect related medical records from other health providers who have been, or are currently involved in your holistic healthcare. These may include general practitioners, medical specialists, hospitals or allied health professionals. In the unlikely event you are unable to provide necessary health information (i.e. in emergency situations) we may request information from your nominated next of kin, or other immediate family members (unless, at a prior occasion, you have notified us otherwise).

How we store, use and disclose your information:

Somnocare uses a cloud based electronic medical records platform called "Clinic to Cloud" that adheres to the Australian Privacy Policy 2014. The data is stored in Australia and protected by Microsoft Azure (an Australian government-certified provider of online data security). Some examples where Somnocare will be required to use and disclose your information are outlined below:

  • Account keeping and billing purposes; including required correspondence with health funds, Medicare and other insurance and account providers

  • Referral to, and ongoing correspondences with other health professionals (including hospitals) involved in your ongoing care

  • Where legally required to do so

We may also use parts of your health information for research purposes, in study groups or at seminars, as this may provide benefit to other patients. Should that happen, your personal identity will not be disclosed without your prior consent to do so.

You may withdraw your consent for us to use and disclose your information as outlined in this policy at anytime (except where legal obligations must be met).

You may also be directed to our online forms and questionnaires platform to submit information about your medical history and personal background. These forms are created using "Jotform" who are a leader in HIPAA-compliant forms (The American equivalent of the Privacy act 1988). This means the raw data from these forms is automatically encrypted, guaranteeing the privacy of your health records. Somnocare has a Business Associate Agreement with Jotform that creates binding liability to protect this information. Should you partake in a CPAP therapy trial or purchase of CPAP therapy equipment, Somnocare also uses cloud based platforms to access and download data from these machines, and to monitor and track your therapy progress. These platforms include, but may not be limited to:

  • Philips Respironics' "Care Orchestrator" platform

  • Resmed's "Airview" online platform

  • Fisher and Paykel's "Infosmart Web" platform

Additional consent will be requested at the time of your trial, prior to registering you to any of these online therapy monitoring platforms.

Accessing your health records:

Access to your records can be denied if there is a legal restriction to access, or if disclosure may cause a serious threat to life.

Your medical history, treatment records, x-rays and any other material relevant to your treatment will be kept in the aforementioned "Clinic to Cloud" medical records platform. You may inspect or request copies of our records of your treatment at any time, or seek an explanation from a Somnocare representative. Fees may apply depending on the nature of your request.

If any of the information about you needs to be updated, is incorrect, or no longer applicable please ask us to alter your records accordingly.

Note: Clinic to Cloud also offers a "patient portal" option. Should you opt for this, you will be able to log in and directly access any health records provided by Somnocare.

Note: You must be over 18 years of age to disclose any personal information or purchase any goods or services, or have the express permission of a parent or guardian.

Delivery of goods:

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of Somnocare.

Returns and refunds:

Somnocare handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

All refunds are made at the discretion of Somnocare.
